By downloading, opening, or using Hank (the "Service"), you agree to these Terms. If you do not agree, do not use the Service. omgochi ("we", "us") provides the Service.
You must be at least 13 years old. If you are under 18, you may use the Service only with the involvement of a parent or guardian. You confirm you are not barred from using the Service under any applicable law.
You sign in with Apple. You are responsible for activity under your account and for keeping access to your device and Apple ID secure. Tell us at hi@omgochi.com if you believe your account has been used without permission.
Hank is an AI assistant. You give it instructions; it can answer questions, browse public web pages, produce text, images, and simple web pages, and schedule reminders. If — and only if — you connect a third-party account, it can also take actions in that account. See section 5, which is the important one.
Hank runs on AI. Its output can be inaccurate, outdated, or entirely made up — including when it sounds confident and specific. Check anything you rely on at the source before you act on it, especially numbers, prices, dates, quotes, and contact details. Hank does not give legal, financial, tax, medical, or other professional advice, and using it does not create a professional relationship with anyone. For that, talk to a qualified professional. We don't guarantee any particular result.
Read this one before you connect anything.
Hank can only reach a third-party account — your email, calendar, files, social accounts, or anything else — if you connect it. Nothing is connected by default. When you connect an account, you are the one granting access, and you decide what Hank can reach. You can disconnect at any time.
What follows from that:
We are not responsible for the consequences of actions you instructed or authorised, or for what happens to data in an account you chose to connect.
Don't use Hank to break the law, infringe anyone's rights, harass or impersonate people, or build profiles of someone without a lawful basis. Don't use it for sexual content involving minors, or content promoting violence, self-harm, or terrorism. Don't use it for spam, scams, malware, or phishing, and don't try to get around our safety systems, rate limits, or access controls. Don't scrape, reverse engineer, or resell the Service, and don't use it to reach accounts, systems, or data you aren't authorised to reach.
We may suspend or end your access immediately if you do.
You keep ownership of what you put in ("Input") and, as between you and us, of what the Service produces for you ("Output"). You grant us a licence to host, copy, transmit, and process Input and Output solely to operate, secure, support, and improve the Service. You are responsible for having the rights to any Input you supply. Identical or similar Output may be generated for other users; Output is not guaranteed to be unique, and may not be eligible for copyright in some jurisdictions.
If you publish a page through the Service, you are its publisher. You are responsible for its content, for the accuracy of every claim on it, for any images or text you add, and for any law that applies to it (including consumer, advertising, and privacy law). Placeholder text or imagery we supply as a starting point is a template only — verify and edit it before you publish. We may remove any page that breaches these Terms.
The Service relies on third parties (including cloud hosting, AI model providers, and any accounts you connect). Their handling of data is governed by their own terms. We are not responsible for third-party services, outages, or for content on third-party websites the Service reaches.
Any paid features are billed through Apple and governed by Apple's terms. Subscriptions renew automatically unless cancelled at least 24 hours before the period ends; manage or cancel in your Apple account settings. Refunds are handled by Apple under its policy. Prices may change on notice.
Hank is a small independent project, not a large company with a support desk. It may change, break, or stop. We may modify, suspend, or discontinue any part of it, and may set usage limits, at any time. We don't promise uptime, and we don't promise that data will be kept indefinitely. Keep your own copies of anything you'd be upset to lose.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that output will be accurate, reliable, or error-free.

Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here excludes liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law.
You agree to indemnify and hold harmless omgochi and its officers, employees, and contractors from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your Input or Output, any page you publish, any action you instructed the Service to take, or your breach of these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, including for breach of these Terms. Sections 4, 5, 7, 12, 13, 14, and 17 survive termination.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules.
Before filing anything, you agree to contact us at hi@omgochi.com and try to resolve the dispute informally for 30 days. If that doesn't resolve it, any dispute will be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you and we each consent to their jurisdiction and venue.
If you are a consumer in a country whose law gives you the right to bring proceedings in your local courts, or entitles you to the protection of your local consumer law, nothing here takes that away.
These Terms are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. We may update these Terms; material changes will be notified in the app or by email, and continued use after they take effect means you accept them.
Apple is not a party to these Terms and has no obligation to provide support for the Service. Apple is a third-party beneficiary of these Terms and may enforce them against you. If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Claims relating to the app are our responsibility, not Apple's.
